Legal Warranty
Pursuant to Italian Legislative Decree 206/2005 (“consumer code”) all products sold on this site are covered by a legal warranty of 24 months.
According to the legal warranty of 24 months WTO-Italy is liable to the consumer (natural person acting for purposes unrelated to entrepreneurial activity, business, craft or profession) for conformity defects not found at the time of purchase.
The lack of conformity exists when the product is not suitable for the use to which must serve, does not conform to the description or does not possess the qualities promised by the vendor, not the usual quality and performance of goods of the same type, it is not suitable for the particular purpose desired by the consumer if brought to the attention of the seller at the time of purchase and accepted by the seller (art. 129 of the consumer code).
The lack of conformity that occurs within 24 months from the date of purchase of the goods must be reported within 2 months from the date of discovery of the defect.
Unless proved otherwise, it is assumed that the conformity defects that occur within 6 months after delivery of the asset existed at that date. In case of lack of conformity, the consumer has the right to restore, without charge, of conformity of the goods by repair or replacement (art. 130 of the consumer code). The customer may request, at its option, the seller to repair the goods or to replace them, free of charge in both cases unless the remedy requested is objectively impossible or excessively burdensome when compared to the other. Repairs or replacements must be made within a reasonable time from the request of the consumer; the average time of delivery to the consumer of the product is 24 days.
If within the maximum period of 60 days, the OMC-Italia was not able to return the repaired product, the consumer may request one of the alternative remedies (replacing, termination of the contract, price reduction).
Time and manner of exercise of legal garantee in case o defective products
The customer shall:
1. within 14 days after receipt of the goods to send a written communication to OMC-Italia – Cavallaro Officine Meccaniche- Regione Catena Rossa, 13/E – 12040 Piobesi d’Alba (Cn) – for convenience can be used alternatively our email box info@omc-italia.com;
2. wait for the authorization of the practice of rest which will be communicated by WTO-Italy by mail;
3. prepare the product for shipping imballandolo carefully in its original packaging, including all accessories, instruction manual and everything contained originally in the packaging of the product.
The carrier will contact the customer to agree on the withdrawal of the product (the unavailability the customer’s phone will delay the withdrawal of the product).
OMC-Italia if possible will send the product to any repairs at the Technical Service Centre authorised by the manufacturer (CAT) and/or will replace it with a new product.
Exceed 14 days. shipping costs are charged to the customer.
N.B.: in the case of refund for incorrect/damaged item is necessary and essential that your receipt/tax receipt is placed inside an envelope that must be received with the parcel. In the absence of proof of purchase/receipt will not be issued a refund.
Responsibility
OMC – Italia is not liable for any damage or loss, direct and/or indirect, resulting from the sale of goods and services offered in the catalog published in OMC – Italia, even for delayed and/or non-delivery of the product, nor for the correspondence of the goods with the specifications published on the site, nor for any other fact not attributable directly to the OMC – Italia.

The technical information included in OMC – Italia site are derived from information provided by the manufacturers of the goods included in our catalogue.
OMC – Italia, therefore, reserves the right to change/adapt the technical and dimensional information of catalog products as shall be notified by the manufacturer without notice.
Product Availability
In the product catalogue published on this site since the access and the possibility to submit online order, modify in real time the availability of the product, OMC – Italia does not guarantee the certainty of the ordered goods.
Risk and Ownership
All goods are guaranteed.
Upon delivery of the goods, the customer must verify the integrity of packages and the quantitative and qualitative correspondence with what indicated in the accompanying document (Receipt or invoice).
When you receive the parcel if you see that the package is not perfectly integrates signature “with reserve”. Otherwise we won’t be able to start the practice of reimbursement.

Orders
Orders are accepted only via the Internet (online), by email or by phone at n° +39 0173 615038.
The client that sends the order via the internet through this site will receive, at the end of the procedure, a confirmation notice from place order via e-mail (email), with an indication of its serial number. in the event that, after sending the order, does not appear (after some minutes) the order number, the proposal will be accepted, not as to any legal effect, although for accounting, administrative reasons or for lack of product.
Price
The prices shown on the site, no log-in, include VAT at 22%
By registering to the site/or login:
– to residents within the European Union the prices shown and the invoices will be inclusive of VAT at 22%
– to non-EU residents prices shown and the invoices will be net of VAT*

Right of withdrawal
OMC – Italia recognises the right of withdrawal as provided for by law 206/2005 D.lgs. The term useful for exercising this right is 10 working days within which the customer must inform us by registered letter AR. prior contact by e-mail: info@omc-italia.com
To take advantage of the right of withdrawal is necessary:
1. the customer expresses his willingness to avail themselves of the right of withdrawal in the way described above:
2. the purchased goods are returned undamaged and in original packaging.
3. the product is delivered on time and in the manner described above;
4. delivery expenses are charged to the customer;
5. the goods once you have arrived at our warehouse will be examined to assess any damages or tampering not caused by transport;
6. after checking the integrity of assets, provvedereremo to refund the sum already paid through the same way you made the payment.
7. the refund will be made no later than 30 days after receipt of the goods.
8. the only charges payable by the customer are those relating to the return of the product.
If the customer opts for the replacement of the product, the new product will be sent against him.

Images, texts and graphics
Copying text, images and graphics are not authorized on this site is punishable under law.
Invoicing
For every product purchased from OMC – Italia will be regularly issued invoice and/or receipt.
During the recording phase is required the release of all data required for billing for companies.

OMC – Italia reserves the right, in its sole discretion, the right not to proceed with the shipment of the goods, even after accepting the order, to those customers who are outside fido, or with unresolved or in litigation.
